Terms and Conditions for Sale of Goods

Elizabeth Anne Children's wear Ltd is a UK wholesaler, and as such considers all sales made via this website to be business-to-business transactions, and therefore the Distance Selling Regulations (2000) do not apply nor the updated Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

The United Kingdom left the EU on January 1st 2021. Shipping costs have remained stable and there is a short delay in transit times.

We will no longer charge VAT on any item.

Tariffs are now payable on goods not made in the United Kingdom. We have endeavored to show you the Tariff code and the originating country of our items. Please use the below link for further guidance from the EU as to the expected tariff payable by yourself of our items. The shipping fee does not include the additional tariff fee, this will be payable by yourself , via the couriers to the EU customs agency.

Import Taxes -Including the EU from January 1st 2021
For delivery outside the United Kingdom, you may be required to pay an import tax or duty upon delivery. In some countries, the customs agency may impose a tax/duty on imported goods, and the recipient (you) may be required to pay this tax/duty when the package is delivered.

The customer is responsible for paying any taxes or duties or customs clearance fees, and meeting any other import requirements imposed by the customs agency in their country.

If the recipient refuses to pay required import taxes/duties, the customs agency may prevent delivery and return or destroy the package, in which case the customer will not receive a full refund and may receive no refund based on the following:
1)For international orders denied entry or delivery by customs for any reason (including failure of the recipient to pay import duties/taxes) or refused by the recipient, the customer will not be refunded for the original shipping charge or for any charges assessed by the courier for return shipment to us. As such, no refund will be issued if the cost of return shipment exceeds the value of the product. If the value of the product exceeds the cost of return shipment, a partial refund for the difference will be issued once the product is returned.
2)If the customs agency destroys the package due to the recipient's failure to accept delivery or pay the required import duties/taxes, the value of the merchandise will also not be refunded to the customer. In this case, no refund will be issued.



Every effort is made to ensure that the information held is accurate. However variations in goods delivered may occur for various reasons including:
- Colour may not be accurately represented due to errors in the photographic representations, or variations in display settings and apparatus.
- Details of delivered goods may vary due to differences at time of manufacture. This may be due to the image displayed being a 'sample' as received by the original manufacturer, shortages of original materials, or variations on handmade items. In these cases, we will ensure that the quality and style is not compromised.

- Where the goods are provided in 'packs', we describe the usual pack configuration. However, due to availability, this breakdown cannot be guaranteed and small variations may occur.

Placing an order on this website is considered as an 'invitation to treat' only. As such it is an offer made by the customer and does not constitute a contract agreement. You will be contacted within three business days to confirm the details and agree to the order including any modifications that are required due to changes in stock and/or pricing. For international customers shipping is also agreed upon at this stage. Most orders are dealt with the same working day.

Goods are held for 2 working days following order placement. If no contact is made by the customer we reserve the right to void the order and place the goods back on sale.

Restock Fee
Where goods are returned due to customer error in ordering a restock fee of £5 will be applied.

If we should receive a complaint about any part of our service, by phone, e-mail or letter, then it will be dealt with promptly (we will reply within 5 working days). It will then be dealt with confidentially and effectively.

Returns

Payment
NO PAYMENT IS TAKEN ON THIS WEBSITE
Customers are required to pay in full prior to delivery. -On order placement you will receive an automatic email acknowledgement of "Pending" status.
-We then pick and pack your order and for international customers find our best shipping quote and adjust the invoice. An email is then sent confirming the order status is now "Awaiting Payment" and instructions of how to pay.
*Please note that we pick every order prior to requesting payment, therefore orders placed at night or over the weekend will not change from "Pending" to "Awaiting payment" until we have picked the order the next working day.*
-We accept paypal and credit/debit cards over the phone. You may request our bank details for bank transfer, however please note that we will not dispatch until the funds have reached our account. We manually accept each order to ensure quality and appropriate shipping rates. Please allow 30 minutes between placing the order and telephoning for payment. We use WorldPay's on-line e-payment service and do not hold any card details ourself. Goods must be paid for in advance and we do not offer credit terms.

Worldpay Payments Processing

Orders will normally be shipped within one business day of confirmation of payment on the order. For the UK this means an order and payment received prior to noon will usually arrive the following working day. Orders placed and paid for before Friday noon will usually be delivered the following Monday. We use external courier companies and our collection time varies, orders picked and paid for before noon are guaranteed collection the same day.

For orders placed on Fridays, Saturdays and Sundays, processing commences the following Monday. We aim to despatch these orders on that Monday for delivery Tuesday. However, please note that during periods of very high demand it may not be possible for all orders to leave us on the Monday for next day delivery and you may have to wait an extra 24 hours for the despatch of your goods. You will be emailed once your order is dispatched so you are aware of when to expect delivery.

-Your order status on payment moves to "Paid: Awaiting Courier" and you will receive a payment confirmation email, and information on the expected delivery time and date.
-We will then ship your goods and update the status to "Paid Delivered" once dispatched.
-Where a currency conversion fee is applicable, the customer pays the transaction fee.

Your right to access, correct, erase, and export your data under GDPR
The only data we store is what you type in when you create your account and orders and is the minimum necessary to process and deliver your orders.
i.e. Your Email, Name, Shop name, Customer address, Shipping address, Billing address, phone number and VAT number. By law we are required to keep any invoices raised for 6 years.

We share parts of this data with our payment providers worldpay/paypal in order to process your invoice payments. Any financial information entered within their platforms is not retained by us once the transaction is processed,
